Man who left argument came back firing, causing a shootout, SC cops say

A man who was involved in an argument then got a gun and opened fire, leading to a shootout, has been arrested, according to the South Carolina Law Enforcement Division.

On March 5, 34-year-old Newberry resident Tobias Shyheam Daniels was charged with assault and battery of a high and aggravated nature, SLED said in a Tuesday news release.

The charge is from a May 2, 2025, incident in Saluda, according to an affidavit.

Witnesses told Saluda police officers that Daniels was unarmed when he went to a neighborhood where he was involved in an argument, the affidavit shows. Daniels then left the area, disappearing from sight, only to return with a handgun, according to the affidavit.

Daniels then started shooting the gun, multiple times, at the person he had argued with, and others in that area, the affidavit said.

A shootout then followed in the residential neighborhood, according to the affidavit. It is unclear who fired back after Daniels started shooting.

No injuries were reported, but multiple homes and vehicles were shot, according to the affidavit. Officers who responded to the gunfire located 13 spent shell casings from two different caliber weapons — a 9mm and a .40 caliber — from the road and nearby area, the affidavit said.

“The act of returning to the scene armed and discharging a firearm multiple times ... thereby creating a substantial risk of death or great bodily injury to others constitutes assault and battery of a high and aggravated nature,” officials said in the affidavit.

Information about why Daniels and the others had argued, or if they knew each other prior to the gunfire, was not available.

Daniels was booked into the Saluda County Detention Center and will be prosecuted by the 11th Circuit Solicitor’s Office, according to SLED.

The Town of Saluda asked SLED to lead the investigation, according to the release.

When the shooting occurred, Daniels was out on bond from two separate arrests in recent years.

In August 2024, Daniels was arrested on a second-degree assault and battery charge, Saluda County court records show. In September 2025, Daniels was arrested again, this time charged with third-degree assault and battery, according to court records. Bonds of $5,000 and $1,000 were posted for those respective arrests, and the charges are pending, court record show.

Before that, in September 2019, Daniels pleaded guilty to a grand larceny (value more than $2,000 but less than $10,000) charge, according to court records.
